A hearing was held in the Supreme Court today on the matter of giving 54 days full salary to the employees during the lockdown. The Supreme Court today pronounced its verdict in the matter, stating that the employee and employer (company) should settle the matter by mutual agreement. The state labor department will help with this. The court also said that in the meantime there will be no punitive action against employers who do not pay full wages.

The Supreme Court gave its verdict on a number of petitions filed by several companies, including MSMEs, challenging the Home Ministry's order to pay full salaries and payments to employees during the 54-day period of lockdown. 

Chief Justice Bhushan said during the hearing that we have directed not to take any concrete action against the companies. Earlier orders will continue on this. The Central Government should file a detailed affidavit in the last week of July. The court said that the task of negotiating reconciliation between employees and companies is given to the labor departments of the state government. 

Earlier on June 4, the Supreme Court, while hearing a batch of petitions challenging the Ministry of Home Affairs (MHA) notification on salary payments, saw that a path of reconciliation between the company and the employees could be worked out which led to 54 days salary. Can be given

After the last hearing in the Supreme Court, the court reserved its decision on it. In fact, the companies offering salary are arguing that they are not in a condition to give full salary for 54 days between 29 March to 17 May. He argued that the government should help industries in such a difficult situation. The case is being heard by a bench of Justices Ashok Bhushan, Justices Sanjay Kaul and MR Shah. 

During the hearing on June 4, the court was told that there was a negotiation on salary between employees and companies. On behalf of the government, it was said in the Supreme Court that if any company is saying that it is not in a condition to pay full salary, then they should show their audited balance sheet.

Now It will be too early for us to come to a conclusion on this important economical matter of the nation which is already having a mixed system of unlocking plus lockdown according to the status quo of the coronavirus.

Having said that we can surely that since employer + employee makes up the entire ecosystem of business sector in India. The service sector is the backbone source of employment for the middle-class people in our country. The Supreme Court must come forward stand out in full sympathy, admiration and support for everyone involved in this matter, after all, "Every Life Matter" in India.
