Is dual employment legal or illegal in India?

Whether dual employment in India is legal or not, is a complex issue with no simple answer.

According to the factories Act of 1948 restricts factory employees from working in multiple factories simultaneously.

Whereas Industrial Employment Rules may limit dual employment based on industry and company regulations.

However, outside of specialised areas, Indian labour regulations do not specifically prohibit dual employment.

While the constitution guarantees the right to work, which allows for multiple job holdings.

In some cases, working two jobs can lead to conflicts of performance issues, termination, or disciplinary action if contract terms are violated.
